• Transfer Of Equity- Outgoing Party Lives In France

    Good afternoon,
    I currently have a joint mortgage with my mother; I am re mortgaging with my partner. We have an offer which is in process, as part of this my mother needs to instruct a “Solicitor, Licensed Conveyancer or Chartered Legal Executive” to receive independent legal advice before the transfer of equity can complete. The outgoing party, my mother, has retired to France so we need advice on how to proceed. The new re-mortgage is with Halifax and enact Conveyancing Limited is acting for my partner and I.

    Are they insisting on her receiving legal advice or just on her providing an ID1 form signed by a lawyer? Although the ID1 form can be signed by a lawyer practising outside the UK, evidence of that lawyer's entitlement to practice in his jurisdiction would need to be supplied. The problem is that the Land Registry will not offer any guidance as to what evidence is acceptable. I'm afraid your mother might need to make a trip to the UK to see an English lawyer, unless there is a lawyer with a current practising certificate issued by the Law Society of England and Wales who is working near her in France
