• Transfer Of Equity - Solicitor Or Lender

By Guest on 18th Jul 2019

In 2006, I signed a letter from my ex’s solicitors that said if I signed the letter I would agree to transfer the property into my ex’s sole name and I would be released from the mortgage. I did this and further signed the transfer form that came after, I didn’t have any legal representation, I couldn’t afford it. I’ve found out that my name is still on the mortgage and the lender said there has been no contact with them at all since taking out the mortgage. So, could the transfer of equity have been done without the lenders permission? I have tried to contact my ex’s solicitor but they said that perhaps the lender didn’t agree at the time to the transfer into one name but then if I had known that I wouldn’t have signed away my rights to the property. They won’t return my calls or emails now. So I am stuck in limbo with my name on this mortgage as I can’t get another mortgage until my name is off and my ex refuses to take me off now. I’m not able to afford a solicitor and I can’t get legal aid so not really sure if I cAn do anything?

I don't know enough about the circumstances nor content of the letter. All I can advise is your best option is to hire a lawyer to advise you as soon as you can.
