• False Information On Spif

    On SPIF vendor stated liability for 100 ft fence on right of property in poor repair was not his responsibility. I verbally queried responsibility for fence with estate agent and conveyancer. I completed sale and subsequently found that damaged fence is my responsibility and will cost over £2000 . What action can I take to recover the costs from either the vendor or conveyancer?

    This depends on what the title deeds say about who is responsible. If the deeds say that the fence is your responsibility then your seller is probably off the hook and you may have a negligence claim against your solicitor if he didn't advise you properly when you asked. If the deeds don't say anything then your solicitor can only rely on the information on the spif and it depends what your seller knew. How did it come to light that you were responsible?
