• We Purchased A House Now The Council Is Saying We Are Breaching The Rules Of The Annex

    We have the council coming to see us as they say the annex is on the next door neighbours land. When we bought the house we had a full survey done and it wasnt picked up?

    It wouldn't necessarily have been picked up on the survey as the surveyor wouldn't usually have known the position of the legal boundaries. Your conveyancer ought to have provided you with a copy of the title plan to allow you to check the boundaries on the ground against the legal boundaries, which should have shown up any discrepancy

    If you were provided with the Land Registry plan prior to exchange, if it was ascertainable from the plan that there was a discrepancy and if you didn't pick this up at the time then I'm afraid so. If the seller knew anything about it though you could have a claim for misrepresentation and if your solicitor had any relevant information which he failed to disclose you may have a claim there two. If this is going to be costly for you it is probably worth seeing another solicitor
