• Selling A House With No Building Regs For Extension

    We had extension to our house, ground floor only, within planning restriction sizes over 10 years ago I believe. Only just realised after conversation with my partner as about to put it up for sale it never had building regs. despite it being built to them. I have been advised get Indemnity insurance, where from I havent found anywhere. Not sure this will help as most of the houses in my road have loft conversions, from what I have read any buyer of our property if we get one, may have problems if they ever applied for permission to build loft conversion. Is this true, what can we do?

    If you wish to correct or indemnity the issue there are 2 options:

    Option (1) Regularisation certificate - apply to building control, usually costs about £300, they will come out after 3-8 weeks and check it. Hopefully they will approve and issue a retrospective certificate. Risk is of course if they do not approve you may be required to carry out remedial works or remove it.

    Option (2) Indemnity insurance (if acceptable to you buyer) - your conveyancer will obtain this, usually costs from £50-£150, and is paid only on completion of the sale. As far as I am aware the insurance brokers do not sell indemnity insurance directly to members of the public; your conveyancer will arrange this for you.
