• I Have Inherited A House That Was Converted Into Two Flats Without Planning Permission

    The house was bought in the 1970's and has been rented as two flats for at least 20 years. It is freehold. Should it be converted back to a house to sell? Or can we sell one as freehold i.e. the bottom flat and the upper flat as leasehold with the ground floor holding the lease. It has been suggested that the council would rather it stay as two flats due to the housing shortage? Would appreciate any advice

    If its current use has continued for 20 years (and you can prove it) then you don't need to worry about planning consent - the council would have had to take enforcement action with 10 years of the original breach (see s171B(3) Town and Country Planning Act 1990). You should look to sell the property as two separate leasehold flats
