• Conveyance Drawing Doesn’t Match Build Plan

    I’m looking to buy a new build house. The property is accessed by a private non adopted road with a turning area adjacent. However the conveyance drawing doesn’t show the turning area. The area in question is shown as part of the neighbouring drive. Will I lose the right to use the turning area if the drawing isn’t corrected before completion? Many thanks

    It depends on how the transfer/lease is drawn up. If the transfer shows you have rights of way over "land shaded brown" for example and the brown shading is in the right place, then the underlying building lines (usually black lines) are not hugely relevant, though if you have not completed yet it's worth asking for them to be corrected. If they are just from the Land Registry title plan though the seller might not be interested in correcting them - Land Registry records of building locations are not kept up to date and it's the brown shading and red border and other such markings that really matter. If of course the brown shading (or whatever it is) is in the wrong place then yes that should definitely be corrected as you would only have rights over it. Take advice from your conveyancer as this is one of those queries where they will really need to look at the documentation to give you accurate advice particular to your circumstances.
