• Who Is Responsible For What When A Property Has A Flying Freehold?

    My neighbour's bedroom overhangs my ground floor toilet. She has discovered a damp patch which is caused by water seeping through poor brickwork on the exterior wall outside her bedroom. I currently don't have damp in my toilet. She would need to access my garden in order to repair the brickwork. Who pays for these repairs? Is it 100% her responsibility or 50-50? The wall is her bedroom wall but the wall is also essential to the integrity of my home which could suffer from damp at a later stage. I'm not aware of a title deed stating anything about a party wall but legally is this what this wall is?

    I advise you instruct a conveyancer (and perhaps a surveyor) to inspect the title deeds and advise you accordingly. It is possible that the title deeds do not say anything about the situation.
