• Priority Of 2 Conveyances

    We are involved in a boundary dispute. There are 2 conveyances, one dates from June 1930 which whilst it shows the size of the land of property B it doesn't show any measurements that place it accurately on the ground. The second Conveyance dated December on property A not only shows the sizes of the plot but also clearly marks out measurements from an exiting road where on planet earth it sits. These two conveyances overlap and it is claimed that the June 1930 takes preference as it was first despite the fact the December conveyance clearly places the plot. We are looking for definitive legal advice as to whether this is indeed the case and a court is likely to put chronology before clarity. Any advice would be gratefully received thank you

    I feel your pain but you will not get the definitive answer that you seek unless you litigate this matter and the court makes a determination. If you can agree with your neighbour as to the boundaries it would be sensible to have a document drawn up sign by all the parties and registered with the land registry. If you can't reach an agreement then, I'm afraid you will need the help of a court. I would warn you however that these matters are extremely costly and take ages to resolve. Perhaps consider arbitration? Good luck
