• Part Of The Garden Is Not Legally Mine

    I am about to exchange contracts on a property. It has been discovered that part of my garden is not legally mine although it has been built on an existing site and the fence has been erected in the same place as the previous property. There is a caravan site behind the fence and clearly they are not aware that this part belongs to them. Could I take out an indemnity in case they try to claim it back at a later date which could mean I lose half of my garden?

    You may be able to get a policy provided the land in question is not registered land but otherwise you won't. Speak to your solicitor. If the land is unregistered you should consider making an application to be registered as owner with possessory title, if the criteria are satisfied.
