am a tenant at the vineyards apartments in Arlington, TX. I recently moved in two weeks ago. Now I am being evicted for non payment of rent and not turning on my utilities. It was my understanding the 399 i paid was deposit and my first month was free. I was so desperate to move thru this process, with all that was going on in the managers office that day I may have made a poor decision by leasing here. But My family and I were in need and I proceeded. The apartment had been delayed a week after giving them the deposit they said it wasn’t ready. Well i got the lease, We signed it (later I noticed not all pages werent signed)_and i go to get my utilities turned on and they cant because the address they type on the lease is incorrect and the address doesn't exist. So i argued and argued and found out it was the apartments mistake. So i was going over my lease and and noticed that no where on my lease did it show that i gave 399 dollars for a deposit. I spoke with the manager he said he would amend. He did and he gave me a copy unsigned. The ammendment shows the 399 went to rent and now its prorated I think it says I am suppose to pay 685 for the first month but i am not sure. So i go home and nothing i call them and report the dishwasher is broke the paint peeled off the wall the cock roaches every where and the kitchen sink is leaking. This apartment looks nothing like the ad in the paper or the model that was shown to me. I have pictures. Well I felt like there was an understanding regarding my first months rent. One understanding between me and the lady who rented me the apartment. Jennifer. Who I come to find out was fired for I don’t know what. So my husband and I hussled to make the rent thinking it was 935. and we didn’t make it. The rent was due on the 1st. On the 2nd I called and left a message. They never answer the phone. I told them I would be late and I would pay late fees of 100 for 1st day and 10 each day after. And even as I was saying it. That seems outrageous. How can anyone survive or live on a contract like that. Poor decision on my part. Well I left the message Saturday. Sunday there was an order to vacate in 3 days I have until tomorrow to find a home for me and my family.
If they don’t want me here I don’t want to be here. But I need more time to find another place. Also I don’t want to have this eviction on my name because It will effect me everywhere I go and I have good rental history. Is there anything I can do legally.
