• Shared Ownership With Housing Association

By Guest on 24th Oct 2015

My eldest son is Personal Representative of his mother's estate(who died interstate) she has lived as leaseholder under a shared ownership lease in property and now my son wants to assign the lease into his name in place of his mother, but the housing association are not prepared to agree to this as they say He has not given them proof of income and therefore ability to pay the rent. All rent instalments have been paid to date and accepted and although some repairs are necessary now these cannot be undertaken by my son as he is not yet the leaseholder. The housing association cannot under the terms of the lease unreasonably withhold their consent to assignment and I consider that as there are no rent arrears it is obvious my son can afford the rent and they are acting unreasonably. What do you think
