• Shared Alley By 5 Properties All With R Of W. Ingress And Egress With Carts Horses Cattle

    The alley is being sold by the existing owner, a house renovator, who lives elsewhere. Can any new owner alter or interfere in anyway with our R of Ws all are written clearly in our title deeds. There is no mention in the current owners title deeds of having a R of W, parking rights or anything that makes us, the property owners think there is anything a new owner could do to make changes. Are we right? This is causing us much worry and distress.

    I would advise instructing a conveyancer to look into the matter for you. At a very general level, without seeing the deeds, a right of way cannot be obstructed. If you think the right of way is missing from the other property's deeds and should be on there, you can contact the Land Registry to ask if this was missed off registration and should be recorded.
