• Restrictive Covenant

    We own some land which has a restrictive covenant that says should planning permission be granted then upon sale or transfer of said land the upkift in value must be paid to the previous owner, we have recently gained planning permission and therefore dont wish to sell the land but would we be able to lease thevland to a home builder or is a lease the same as a transfer in this instance?
