• Leasehold Extension Query

    I had an extension several years ago on my leasehold property. No one told me at the time that I needed to get permission from the leaseholder.. I have only found this out years later . Very worried now... what should I do?

    Option 1 - Do nothing and hope they don't find out. The more time that passes without them objecting the less risk there is.

    Option 2 - Sell your property (but the buyer may raise a query on the extension and bring this issue up)

    Option 3 - Obtain a breach of lease indemnity policy

    Option 4 - Ask for retrospective consent from the landlord (but they will charge, which could be quite a lot, and in the worst case scenario they could ask you to restore the property to its previous state, though this is very unlikely)

    Option 5 - Consider whether you may be able to purchase the freehold (e.g. through collective enfranchisement or freehold enfranchisement if it is a leasehold house) and thus become the leaseholder yourself which removes the issue.
