• Leasehold Agreement Includes Garage Not In Title

    I am in the process of purchasing a leasehold flat built in the 80s. Originally the flat was assigned a separate garage but it seems it no longer does.
    The freehold documents show the garage was "determined" from the title and a separate lease for the garage also created.

    However the leasehold agreement for the flat that I am effectively being asked to sign through a license to assign and deed of covenant is the original lease that still references a flat and garage.

    My solicitor has not provided any clear guidance and the estate agent tells me it doesn't matter as the freehold title shows the garage has been "determined" and is pushing me to exchange contracts.

    Could you help me understand if it is safe to go ahead and sign the contract with the lease still incorrectly referencing the garage?

    The lease would not have been altered when the garage was removed, only the legal title, so yes it is ok to proceed
