• Lease Not Signed

By Guest on 22nd Jul 2016

I am buying a leasehold flat. On the last page of the Certified Copy of the Lease, the Freeholder has signed (and had the signature witnessed) but there is no signature by the Lessee (and hence no witness either). The leasehold title is registered in the name of the seller (ie the Lessee whose signature is missing from the Lease). As the title is registered, does it matter if the Lessee did not sign the lease?

Usually when a new lease is granted there are two identical copies - an original and a counterpart. The landlord signs the original and supplies this to the tenant who lodges it for registration. The tenant signs the counterpart and supplies it to the landlord. This copy doesn't need lodging with Land Registry, so I think there is no problem.
