• Is The Solicitor Entitled To Rely Solely On Answers Given In Property Information Forms?

By Guest on 03rd Sep 2021

My vendor stated on the property information forms that no breach of lease had occurred when it later transpired it had (owner before them got new windows without permission from freeholder) so when I came to sell the property I was liable for the cost of a retrospective license to alter. My solicitor says they weren’t negligent in failing to pick this up as they’re entitled to rely on the information given in the forms - is this correct? My buyer’s solicitor obviously made further checks which is how it came to light, so why didn’t mine?
