    We are asking for access to freeholders courtyard to erect a scaffold tower for three days to make adjustments to a window but he is refusing citing that he is selling, he has exchanged but not completed; can he do this?

    He is legally responsible to the point of completion. Imagine if the buyer defaulted and withdrew prior to completion. The current freeholder would remain responsible.

    It is possible he is just trying to defer the issue (hold you off) until completion whereupon he would indeed then no longer be responsible, thus leaving the issue for the buyer to sort.
