• Do I Need A Deed Of Variation To Sell My Flat?

    I am selling my flat and buyer is requesting that I must pay for a Deed of Variation as the loft is not part of the demise on my lease and neither on the other freeholder's lease. Do I or should I be paying for this? Estate agent also mentioned that I cannot sell my property without it. Is a DoV compulsory?

    Any advice would be appreciated.

    If you are occupying the loft as part of your property but the lease does not say that it is part of your property then yes, you are unlikely to find a buyer who will be happy to proceed without the lease being varied.
