• Determination Of Lease

    I am both the freeholder and leaseholder of a leasehold flat. I wish to apply for determination of the lease (on grounds of frustration, as the 'thing in question' is now fundamentally different from when the leasehold was purchased. this particularly goes to payment of ground rent. However, form AP1 does not appear to provide for an account of the facts and I know that to determine a lease by frustration is quite rare. Is it possible to provide a Statement of Truth to support my application?

    The frustration route isn't applicable here, it would only be useful where a tenant wished to terminate a lease and the landlord was opposed. You can simply submit form AP1 and state in the section describing the application that you wish to merge the titles
