Hi , I live in a 1st floor flat in a converted house, the garden flat has sole use of the garden to the rear, in 2000 the fence to the garden blew over in a storm and my neighbour downstairs replaced the fence without notice or consultation and then asked me to pay for half of it after it was done which I refused to do as there was no mention of the garden or fence in my lease, in the last few days the roof has started to leak and I got a quote for repairs and informed my neighbour downstairs, she now 18 years later said to take her contribution from the money I owe for the fence ( I don't believe I do ), over the years she has asked me to pay half for the pruning on her tree which I also declined to do, we have shared in other roof repairs and the decoration of the outside of the house and front gate etc which is all stated in the lease.
I'd be open to contributing if I had a share in the garden or if it was my responsibility but I see nothing that says I am. We have recently jointly bought the Freehold. Do I share in the maintenance of the garden flat fence and trees if there's no mention of it on my lease ?
