• Trasnfer Of Share Of Freehold (TR1)

    Hi there,
    I solely hold a 50% share of freehold of a 3 flat building, alongside one other (Mr B) who holds the other 50%. I am in the process of selling to a unmarried couple - Mr C and Ms D.
    On the proposed TR1 form under section 5 the new names are Mr B, alongwith Mr C and Ms D all as independant entries; does Mr. B still retain 50% of the freehold, whereas Mr C and Ms D share their half of 50% (25% each).
    On section 10, the second box is currently marked which states tenants in common in equal shares.I assume this wouldn't mean 33.33% each? Ie. the current other share of freehold (Mr B - not involved with my sale) would be at detriment by my sale?

    It does not really matter to you but Mr B should insist that box10 altered to show that the property is held in unequal shares of 50% to Mr B and 25% each for c and d
