• Regulated Tenancy

    Hi, I recently have purchased a property at auction with a regulated tenant and have no information on them apart from what is provided on the rent register. This is the dilemma I am facing, as I am new to this it was my mistake in not asking to have the tenancy agreement beforehand thinking it was the same as an AST and that I could give them a section 21 notice after their fixed term had ended.
    What would be the best steps to take as I would like to get the tenant removed ASAP.

    Hello,

    Thank you for your question. If this is a tenancy regulated by the Rent Act 1977 which is how it sounds then you cannot usually terminate the tenancy unless the tenant is in breach and even then it isn't easy. Essentially the tenant has the right to remain in the property for life and the tenancy can potentially be inherited by someone living with the tenant at the time.of his / her death. The amount of rent you can charge is strictly.controlled by statute. You will need to seek specialist legal advice from a solicitor specialising in landlord and tenant law.
