• Housing Asc Land?

    We are purchasing an ex council property with a small piece of land to the front garden with we understand still belongs to the council but the current owners believe that it belongs with the house as they have maintained it for 25yrs? Is this so.

    The mere fact they have maintained the land does not grant them title to it. They would have to apply to be registered with possessory title. To be successful they will have to prove both an intention to possess the land and that they have been in actual possession for at least 12 years. This assumes the land is unregistered - if it is registered it is more difficult to acquire the land in this way. Just having maintained the land would not usually be enough to prove actual possession, they would usually have had thave fenced off the land.
