• Buying A Flat In A Large Block, But Found Out That The Landlord Has Passed Their Maintenance Obligation To The Tenants

    The solicitor representing me didn't bring this to my attention whilst I was buying the flat - that the flats were so poorly managed, and I have had to spend a lot of money so far for essential safety (gas electric works) no safety checks undertaken for a while and no certificates available. Can I take action against the solicitor for poor representation? I found out that the landlord passed all obligations for maintenance in some sort of law document some time ago, surely the solicitor should have picked up on this?

    It depends on what sort of obligations you are referring to. It is normal for tenants under long leases to be responsible for maintaining the gas and electrical installations which serve the property exclusively. The landlord is generally only obliged to maintain the main structure, the communal areas and any service installations which serve the block as a whole. Can you provide a bit more detail?
