• Stamp Duty On 2nd Property Buy To Let Mortgage And Staircasing

    I own 85% of a property in my own name since 2013 and I am looking to remortgage to buy 100% and transfer to a buy to let mortgage. I also own a house in joint names with my partner since September 2015. Will I need to pay additional stamp duty following new rules in April to buy the extra 15% from the housing association?

    Yes you will. The amount you have to pay will depend on how much you paid for your initial share, how much that share was and whether you elected to pay stamp duty on the initial market value when you bought your initial share. Your conveyancer can work this out for you.

    If election was not to pay SDLT on the first share and at that time the property was the only/main residence, will the additional stamp duty also apply to the first Share when stair casing to 100% ?
