• Getting Mortage Release From A Dead Persons Heir

By Guest on 18th Apr 2016

I have lost my Mortage Release for a Mortage made in 1985 with a 10 year mortgage. The mortgage was paid off in 1995. One of the two mortagees died in 1990. Her heir is still alive and I need a Mortgage release. Who can legally sign for the Release

The executor(s) of the deceased can sign it

I found since my question that the mortgage, died without an heir. The lady who was called her daughter was never legally adopted so the mortgagee died without and heir or family. The woman who thought her entire life she was the adopted daughter found that was not true. She was Co-Mortgagee and has signed a mortgage release and a statement of fact under penalty of perjury with a Notary Public as witness. The title company did not accept this document as a legal mortgage release.
