    Why do I need to register my house

    S4 of the Land Registration Act 2002 says that any disposition (a change of legal ownership or the granting of a legal mortgage) must be registered and if it isn't then the disposition has no legal effect, so for example if you buy a house but don't register it the seller could then take out a mortgage on the property and your ownership would be subject to the mortgage - you wouldn't have to pay it but if seller didn't then the lender could repossess and sell and there would be nothing you could do. You could sue the seller but you couldn't keep your property. Similarly if the seller sold it again to someone else you could sue the seller but you couldn't stop the buyer moving in and evicting you. You would never be able to sell your property until you were registered as the owner nor could anyone inherit it from you.

    There is no obligation on you to register a previously unregistered property until a registerable disposition takes place however.
