• Who Can Request The Land Registry For A Rectification To A Title Deed?

    I am selling a property (residential) 14 months after I purchased it and have just been informed that there is a right of way on my property that belongs to the original sellers so this is now preventing me from selling my property. I have asked the original sellers to deal with the ROW as this should have been done when we bought the property from them, but they are not reasonable people and are refusing to help. However, it now transpires that the problem is one of incorrect mapping of boundaries by the Land Registry and that thr ROW is not on my property. My current solicitor acting for my sale says that the original solicitor who dealt with the purchase has to request the rectification from the Land Registry. Is this correct? Is there any reason why my current solicitors acting for me on the sale can't do this? I am seeking a way forward and so far all I get is that its' someone else's reponsibility. Thank you.

    It's up to your current solicitors if they want the work/if it's within their experience to do. Perhaps they do not have sufficient experience to do it. It sounds like it may (subject to full knowledge of the circumstances) have been something the lawyers who acted on your purchase should have attended to at the time. You should be able to instruct any conveyancer to handle the matter.
