• Removing My Husbands Name From The Title Deeds Of The House

By Guest on 28th Jul 2015

My husband wants to remove his name from the joint ownership of our house in my favour. There is no loan on the house. He has estranged children and as I have contributed the miss he wants the house to be mine

In that case you need to do what is called a transfer of equity. You may wish to purchase our transfer of equity kit. Essentially this means your husband signing a transfer in your favour. You can arrange a solicitor to do this for you or you can carry out the work yourself. If you carry out the work yourself you will need to go to a solicitor or to the land registry office to verify your identity

Thank you for your response it has really helped. Is it very difficult to complete the equity kit. I do understand we will need legal help advice as well. There will be no money changing hands. Is there a tax implication, neither of us are tax payers. The house is worth approx £300.000. My husband just wants to protect me in case his estranged children contest the will when he dies.
    Thank you very much.

You should seek specialist advice from a solicitor specialising in tax planning and probate rather than relying on our kit given the reasons you state for carrying out the transfer. I say this because simply transferring the property may not be enough to protect you from the interests of your husbands children.
