• First Registration Of Property With Missing Deeds And Joint Ownership.

    The property was jointly owned by my Father & Aunt...since about 1971. My Father died 4 years ago, so his half passed to my Mother, though the deeds & important docs were missing,and so had remained unregistered. My Aunt then died last Oct'16 intestate. So her share has passed to my myself and my brother, due to blood line. The Solicitor has advised that we register the property in just our names as we are the Executors, but not my Mothers too, although i'm told this won't affect her ownership, but she won't have legal rights? We have all decided to sell to simplify things, but my concern is that myself and my Mother are estranged from my brother, so my worry is that he may not agree to spilt the proceeds with our Mother...or 'make it difficult'. Am I worrying unecessarily or will she be protected by law?
