• Changes To Registered Owners

    Hello,
    I have questions about registered owner's for 2 scenario's.
    1. A freehold house with no mortgage is jointly registered in the name of a father and his 2 sons. The father bought the house on his own in the past and later added the names of both of his sons(both of whom have zero financial contribution in the house). How can the name of 1 son be removed from the title deed? Is his consent necessary? Can the father being the original sole buyer and owner of the house just remove one of his son from the deed? In case of dispute is it required to prove that the son has not made any financial contribution? Does he need to show he has invested his money into the house at some point?

    2. A freehold house with no mortgage is jointly registered in the name of a father and daughter. The father bought the house on his own and later added the daughter's name(who has zero financial contribution in the house). How easy it is to add another daughter's name to the deed? Is consent of all the joint owners required for the extra addition? The documents required? What if the already registered daughter refuses consent? Can the father being the original sole buyer and owner of the house override the consent and unilaterally add 2nd daughter's name?

    Hi,

    1. Irrespective of who actually put up the money for the purchase a transfer (TR1) would be needed to take someone off the title and without a court order all 3 owners would need to sign
    2. Again a TR1signed by all current oowners would be required
