• Change Of Ownership After Death

    Myself and my ex own property as tenants in common on a 50:50 basis.
    My ex has passed away with no will.
    We have 1 daughter so she is the sole next of kin. She has applied for probate.
    I want to transfer her late mothers half of the property to my daughter. But I want to keep the whole debt on the property in my name only as my daughter is 19 and going to University in October.
    My mortgage company (Santander) are blocking me as they say they don't allow joint names on land registry and single names on a mortgage. They need joint names on both. But they refuse to include my daughter on the mortgage as she is a student. Is this a rule which is enforced across the land? Or is it just my mortgage provider?
    I know it will end up with solicitors being involved but was just curious.
