• Transfer Time Limit

    Hi, I have purchased your DIY Equity Transfer Kit in which it says (under the heading 12. Submit the AP1) "There is a legal obligation to register every transfer and if this is not done within the 3 months the land registry can declare that the transfer deed is invalid and in which case it may need to be re-executed. In addition the beneficiary of the transfer is not protected until it is registered."

    Can you point me to any legislation I can refer to which specifies this time limit please? My concern is with a restriction (in favour of a bank) which was apparently transferred to another party a couple of years ago but which remains in the original bank's name.

    I'm trying to find out a. what the legal position is b. what THEY should/need to do about it and c. what I can/need to do about

    This time period actually only relates to land that is currently unregistered. However a transfer of registered land doesn't take effect at law until it is registered. If a person has a restriction which they are not entitled to then they are obliged to remove it.
