• Probate Sale

By Guest on 08th Feb 2018

My children are the beneficiaries of my ex-wife's estate following her death last year. My daughter is executor and is dealing with the sale but my son is still living at the property as he cannot move without the proceeds of the sale of the house. The proposed buyer is asking that he vacate before exchange of contracts which means he will be homeless. Is there anything that we can do so he can stay until completion.

There is no obligation to vacate prior to completion, he can stay until completion, it is on completion that vacant possession needs to be given. So you don't have to do anything- their concern seems to be that at completion he wouldn't have left!
