• New Stamp Duty Changes How Will It Affect Us

    After reading the Government website regarding the Budget changes to stamp duty, with our situation being a bit a complicated i wondered if you could help, at the present my husband and I live in our main residence ( which is in my name only) and rent out our previous main residence (also in my name only) as I understand it, as long as we sell the main residence we live in now, to purchase a new main residence we wont have to pay the higher stamp duty rate? However my husband is still on the mortgage of his previous home where is ex wife lives with his children, we have a deed of trust arranged with the land resgistry to give his share of that family home to his 4 children, is this classed as gifting? or would this mean we still have to pay the higher rate? as you can see this is complicated, I have tried to ring the tax office but they wont answer question regarding this matter, can you help? regards Catherine
