• Do I Need A Environmental Search To Be Carried Out If The Lender Does Not Require It And There Is No Technical Record/reason To Carry One Out?

    i am a buyer and My Lender does not require an Environmental Search report and there isn't anything in the area i know of to suggest one needs to be carried out, so why would my Conveyancer carry one out?

    A conveyancer is obliged to the lender (any lender) to carry out "all usual and necessary searches and enquiries". It's accepted conveyancing practice these days, rightly or wrongly, to carry out the search - unlike some other searches like coal mining or china clay it is not restricted to certain areas - so conveyancers have to carry them out. If they didn't and the land turned out to be contaminated causing the lender to suffer a loss it would have a strong claim for negligence
