• Restrictive Covenance

    The lady next door has told me that I cannot teach private yoga sessions in my home due to a restrictive covenant in place - I teach in clubs and spas and rarely have someone coming to my house and I don't see this as "running my business" from home - how can I get some legal help about this as she is trouble and is trying to stop me doing this! She stopped another neighbour teaching piano lessons from his home!

    Presumably there is a covenant on the deeds saying that the property is not to be used for business purposes. In order to enforce it she would have to obtain an injunction from the court, for which she would have to prove a) that she was entitled to the benefit and b) that she has suffered a material loss as a result of your breach. Assuming your activities do not cause nuisance (extra traffic leading to parking issues, excessive noise etc) then this latter part would be difficult to prove. Call her bluff and see if she pursues it - it won't be cheap for her
