• Unknown Covenants

    I have unknown covenants re my house which I am selling. I have been told to get an indemnity insurance policy to cover the defect title. I wish to know how much will this cost and this house has been built over 62 years now and I would of thought that any claim would be null and void.

    The cost will depend on the value of the property. As to whether it is required, the rule in Hepworth v Pickles [1900] says that where a covenant has been openly and uninterruptedly breached for 20 years or more acceptance of the breach (and therefore consent) is implied, so there is no risk to insure.
