    Does this mean the buyer can not get a mortgage to purchase the property? The contract for sale is personal to the Buyer and is not capable of being assigned charged or mortgaged

    If contracts have already been exchanged with another buyer then that that buyer has an equitable interest which will override any new buyer's interest
