• Transfer Of Deed

    I have a house jointly with my ex. we are both on the mortgage and title deed.
    the mortgage is due to end soon, my ex wants to give the house for me as he never contributed and our three children are living with me.
    what is the easiest and cheapest way to go before or after the mortgage paid off. I.E is it better to arrange something before loan paid or after, and can get from deed at time of registering with land registery

    You are probably better off waiting until the mortgage is paid off as otherwise you would need the lender's consent and they are not obliged to give it. Once the mortgage is paid off make sure that the lender removes its charge at Land Registry and then the transfer will be pretty straightforward. You can do it yourselves though it would be easier if you instructed a conveyancer to act for you. Your husband doesn't need to b represented really. In the meantime you could look at entering into a trust deed whereby your husband agrees that you are entitled to 100% of the equity, in case he changes his mind before you can do the transfer
