• Tenants In Common Gifting Property

    My father we found out is on my house deeds he was meant to be only guarantor my mortgage is coming to an end and we want to correct this by putting it into my sole name.My father didn't buy the property no financial input at all I have paid for everything.Can he gift me the property or will he incur capital gains tax.if so if the "price" of property date from when he came on my mortgage or when me and my ex husband bought it.(father came on when I was divorced)

    From a legal perspective as a conveyancer, he can gift you the property if it is mortgage free.

    From a tax perspective, check with an accountant or tax adviser.
