• Buying An Unregistered Property Would It Still Be Liable For A Chancel Claim As We Are Past 2012 Deadline?

    I see on this site that the church had to register for chancel liabilities by 2012. Does this mean that if I buy a property that has not been registered with the Land registry as yet that I don't need to worry about chancel claims , ie that I don't need to do a chancel search as we are past the deadline

    The deadline is 13th October 2013 so theoretically if the church has not registered a land charge by now then once the next transaction for value is registered they are out of time however there is still the possibility of legal challenges to the new law by the church so until the first cases are decided in the courts it is better to do a search and get the insurance. Plus you are at risk until your purchase is actually registered.
