• Who Pays Conveyancing Fees Etc

By Guest on 13th Mar 2016

My sister and I inherited my parents house, she transferred her share to her husband and he also bought my share, so he now owns the house, he now says I owe him half his conveyance fees etc, is this fair?

No. He has a contract with his solicitor which is personal to him and he is liable to them for the whole bill - they cannot claim any money from you as you have no contract with them. Likewise, unless you contracted with him to pay half the fees (beware that even a verbal contract might be enforceable) he cannot make any demands of you. If he wanted that to be part of the deal he should have negotiated for it before the deal was complete.

Thank you for your answer, the only verbal agreement we had was to pay half of any expenses incurred before the purchase, ie utility bills etc.
It was never about the money, it was the fact he was not up front about it, and suddenly presented me with a bill for half the money & inferring that I as the seller was liable for half.

That said I have paid him but only to preserve my relationship with my sister.
