• What Are The Options When Indemnity Is Not Possible?

    We are in the process of buying a property which has a paved driveway and drop kerb installed. It turns out the drop kerb has permission from the highway authority but the not all of the drop kerb is adopted highway. The land is owned by the local planning authority. My partner contacted the local planning authority to find out if there was an easement in place, not realising that this would prevent us from getting indemnity insurance. It turns out there is no record of an easement.
    Is it best to walk away or is there another way to overcome the drop kerb not having permission?
