• Release Of Funds

By Guest on 09th Apr 2016

My purchaser's solicitor claims that he cannot contact me directly as I am not his client - he can only speak to another solicitor. Is this true? He also states that he cannot release funds directly to me. Can you comment on that please?

Are you represented by a solicitor or are you representing yourself?

Yes my aim is to represent myself but this will prove difficult if he is unwilling to deal with me directly.

There is nothing in the law or in the Code of Conduct for Solicitors that prevents him from dealing with your directly however some firms adopt a policy of not acting in matters where the sellers or buyers are representing themselves and they are entirely free to adopt that policy. If he will not act unless you are represented then unless your buyer is prepared to switch solicitors to someone who will deal with you, you will have to instruct your own lawyer
