• Planning Permission Conditions

    We are relocating back from Italy to the UK. We are looking to exchange contracts on a house purchase urgently. We have found a couple of landscaping linked planning permission conditions which we do not believe have been fully complied with. Could we make the putting right a condition of the contract? And therefore exchange with this as condition?

    You if you are a cash buyer could but you run the risk that if the seller fails to honour the agreement you may need to do the work yourselves and sue the seller. There is always some risk of losing such a case as well as the risk of the seller not having the money or disappearing. If you are getting a mortgage your lender will probably not allow the case to proceed until the conditions are discharged.
