• Planning Indemnity Policy

    Hi, I'm in the process of selling my property and my buyers solicitor has requested we take out an indemnity policy to cover an extension that has been in place for over 18 years that they are unable to trace planning permission for. Due to the length of time I understand that enforcement would not be an issue so can't see any need for this policy. Is my understanding correct?

    The local authority have 4 years after completion of works for which planning consent was required but not obtained in which to take action so after 18 years you are ok and there is no need for a policy. There are two other issues where a policy might be need though, that is lack of covenant consent and lack of building regulations approval.
