• Married With Sole Mortgage

    Hi I have been married for 11 years and 5 years ago my husband band I bought a house with the mortgage being in his sole name as I had an older mortgage in my sole name which I took out before we got married as my husband had an IVA but we wanted to get on the property ladder. Should my husband die or we got divorced in the future am I legally entitled to 50% of the house we live in together (his sole mortgage)? He has two children from a previous relationship.

    Hi,

    If he were to die then whether you got a share of the house would depend on what your husband said in his will. If he didn't leave a will then intestacy rules would apply so you might got the whole house depending on its value (provided you were still married at death). If you were to divorce then you have no automatic entitlement and as with any of your assets you would have to negotiate a settlement as part of the divorce proceedings. If you are concerned you could see a family lawyer now and see if it's possible to draw up some sort of trust deed.
